Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Parabox, including the Parabox mobile application, websites, APIs, services, content, augmented-reality experiences, location-based experiences, multiplayer activities, subscriptions, and related features (collectively, the “Service”). The Service is operated by PARABOX LLC (“Parabox,” “we,” “us,” or “our”). By creating an account, accessing the Service, purchasing content or a subscription, or participating in a Parabox experience, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with the Service. Please review it before using the Service.
1. What Parabox Is
Parabox is an adventure platform that may provide digital and real-world experiences including augmented-reality experiences and puzzles (“Realities”); location-based discoveries and activities (“Anomalies”); multiplayer location-based games and competitions (“Operations”); navigation, route, rendezvous, and exploration features (“Plots”); curated sequences of real-world experiences (“Expeditions”); events and community activities; operator profiles, ranks, designations, progression, recruiting, and social features; digital interfaces, codes, puzzles, APIs, and systems such as Relay; subscriptions including Nexus or successor offerings; and other Parabox experiences and services.
Features may be added, changed, renamed, removed, or combined over time. Parabox experiences are entertainment. Unless expressly stated otherwise, Parabox does not control, own, inspect, or guarantee the safety or accessibility of real-world locations at which the Service may be used.
2. ACCOUNT ELIGIBILITY AND PARTICIPATION BY MINORS
You must be 18 years of age or older and legally capable of agreeing to these Terms to create or maintain a Parabox account.
Minors who are at least 13 years old may participate in age-appropriate Parabox experiences only through the account of, and under the direct supervision of, a parent or legal guardian who is at least 18 years old. Parabox is not intended for and may not be used by children under 13, whether independently or under adult supervision. The adult account holder is responsible for determining whether an experience is appropriate for the minor, supervising the minor's participation, and ensuring compliance with these Terms and applicable safety instructions.
Minors may not create their own accounts, independently use features intended to connect or communicate with other operators, independently participate in meetups or rendezvous with other users, or otherwise use the Service without the supervision of the adult account holder.
If we learn that an account was created or is independently operated by a person under 18, we may suspend or terminate the account and delete associated personal information, subject to information we are legally required or reasonably permitted to retain.
3. Account SECURITY
Certain features require a Parabox account. You agree to provide accurate information and maintain the security of your account and authentication credentials. Your account is personal to you. You may not sell or transfer it, impersonate another person, or provide unauthorized access to it. You are responsible for activity conducted through your account. If you suspect unauthorized access to your account, notify us immediately at [email protected].
Operator handles, IDs, ranks, designations, deployment statistics, and similar profile information may be visible to other users where the Service indicates that information is public or shared.
4. Location-Based Activities
Many Parabox experiences require movement through real-world environments. You remain responsible for where you go, how you get there, and whether it is safe and lawful to enter or remain in a location.
A Parabox map marker, anomaly, route, objective, game cell, suggested destination, or other digital indicator is not permission to enter private or restricted property; is not a representation that a location is safe or publicly accessible; and does not override signs, fences, gates, laws, operating hours, instructions, or property-owner restrictions.
Do not trespass. Do not enter roads, railroad tracks, construction areas, bodies of water, rooftops, utility areas, abandoned structures, restricted facilities, dangerous terrain, or other hazardous areas to complete a Parabox activity. If an objective appears inaccessible, unsafe, inappropriate, or unlawful to reach, do not attempt to reach it. Use any available reporting, reroll, relocation, or skip function.
5. Situational Awareness
Never allow the Service to distract you from your surroundings. Do not use augmented reality or continuously look at your device while driving, operating a vehicle, crossing a street, walking near traffic, climbing, navigating stairs or uneven terrain, or participating in any activity requiring your full attention. Stop moving and move to a safe location before concentrating on your screen or solving a puzzle.
6. Driving and Transportation
Do not actively play Parabox while driving. A passenger should operate the Service, or the driver should park legally and safely before interacting with it. Parabox does not guarantee the accuracy, legality, safety, accessibility, road condition, or suitability of any route.
7. Multiplayer Activities and Operations
Competition does not justify unsafe behavior. Do not run into traffic, drive recklessly, trespass, enter hazardous locations, interfere with the public, damage property, or violate laws to gain an advantage. No score, rank, objective, timer, reward, or result is worth risking injury or violating the law.
Hosts and participants are responsible for determining whether an activity is appropriate for their group. Parabox may invalidate results, remove participants, restrict accounts, or take other action when cheating, manipulation, harassment, unsafe conduct, or abuse is detected or reported.
8. Meetups, Rendezvous, and Other Users
Some features may help adult account holders discover, coordinate with, compete against, or meet other people. Parabox does not conduct background checks on ordinary users unless expressly stated otherwise. Use appropriate judgment when interacting with people you do not know. For first-time meetings, use populated public locations, tell someone you trust where you are going, and avoid sharing unnecessary personal information. You are responsible for deciding whether and how to interact with another user.
9. User Conduct
You may not use the Service to violate law; trespass; harass, threaten, stalk, intimidate, or abuse another person; endanger another person; damage property; impersonate another person or organization; cheat, falsify location, manipulate results, or exploit bugs; access another user's account; interfere with the Service or its security; improperly scrape or automate access; misuse Relay, APIs, tokens, endpoints, or other interfaces; obtain another operator's private credentials; distribute malware; collect information about users without authorization; facilitate unlawful commercial activity; or materially interfere with another person's use of the Service.
10. Operator Tokens and Relay
Certain Parabox systems, including Relay, may expressly invite exploration, interrogation, automated requests, or other technical interaction as part of gameplay. You may interact with those systems only within the interfaces, domains, endpoints, credentials, rate limits, and other boundaries Parabox designates for such activity. Permission to interact with Relay or another gameplay system does not authorize access to Parabox's private APIs, servers, databases, administrative systems, authentication systems, or other infrastructure not expressly designated for such activity.
Certain Parabox systems may issue operator-specific tokens, codes, credentials, or identifiers. Unless expressly designated for sharing, these credentials are intended only for the operator to whom they were issued. You may not knowingly use another person's private token or attempt to obtain unauthorized privileges. Parabox may rotate, revoke, replace, or limit tokens for security, gameplay, or operational reasons.
11. User Content and Highlights
The Service may allow you to submit profile information, reports, messages, photos, videos, highlights, deployment materials, anomaly content, feedback, or other material (“User Content”). You retain ownership of User Content you own. You grant Parabox a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, modify as technically necessary, display, and distribute your User Content to the extent reasonably necessary to operate, improve, secure, promote where you have chosen to share publicly, and provide the Service. This license ends when the User Content is deleted from the Service, except to the extent the content has been incorporated into content shared by others, retention is reasonably necessary for legal or security purposes, or applicable law permits continued retention.
You represent that you have the rights necessary to submit your User Content and that it does not violate law or another person's rights. We may remove or restrict User Content that violates these Terms or creates safety, legal, security, or operational concerns.
If your User Content depicts a minor participating under your supervision, you represent that you have the authority to submit that content. A parent or guardian may request removal of content depicting their minor at [email protected].
12. User-Deployed Anomalies and Scheduled Experiences
If Parabox allows users to create, deploy, schedule, position, host, or suggest experiences, the creator or host is responsible for using reasonable judgment when selecting locations and organizing participants. Content submitted when deploying an anomaly—including media or spatial/AR data the user affirmatively chooses to upload—may be transmitted to Parabox as necessary to create and operate that anomaly.
Parabox may relocate, reject, disable, or remove activities that appear unsafe, inaccessible, unlawful, inappropriate, or inconsistent with the Service. Availability of an activity through the Service does not constitute a safety inspection or guarantee.
13. Nexus and Other Subscriptions
Parabox may offer auto-renewing subscriptions, including Nexus. The specific features, price, billing period, and benefits will be displayed before purchase. Unless otherwise stated, subscriptions automatically renew until canceled. If a subscription includes a free trial, it will automatically convert to the applicable paid subscription at the end of the trial period unless canceled before the trial ends. Features and benefits included with Nexus may change over time. We will provide notice of material changes where required by applicable law.
If purchased through Apple's App Store, payment, renewal, cancellation, and refund processing are handled through your Apple account and subject to Apple's applicable terms. Cancellation generally prevents future renewal but does not terminate access already paid for during the current billing period unless applicable law or the marketplace provides otherwise.
14. Realities and Other Digital Purchases
Parabox may offer individual digital experiences, access rights, credits, replays, or other digital content for purchase. The applicable price and access terms will be disclosed at purchase. Purchasing digital content grants a limited personal license; it does not transfer ownership of Parabox intellectual property. Availability may depend on compatible hardware, software, physical space, location permissions, camera permissions, or other technical requirements.
15. Credits, Trials, and Promotional Benefits
Unless required by law or expressly stated otherwise, credits, trials, promotional access, referral rewards, recruiting benefits, and virtual benefits have no cash value, cannot be sold or transferred, are not legal tender or property, may be subject to expiration or eligibility requirements, and may be modified or revoked in cases of fraud, abuse, mistake, or violation of these Terms.
16. Referrals and Recruiting
You may not use spam, deception, fake or purchased accounts, automated registrations, misleading claims, or other abusive methods to obtain referral benefits. We may withhold or revoke benefits resulting from suspected fraud or manipulation.
17. Third-Party Services and Locations
The Service may interact with third-party services such as app marketplaces, mapping providers, payment processors, communications providers, websites, businesses, and venues. Third parties operate under their own terms and privacy practices. A location appearing in Parabox does not necessarily mean its owner or operator sponsors or endorses Parabox. Unless identified as a Parabox partner, assume there is no affiliation.
18. Intellectual Property
Parabox and its licensors own the Service and associated software, designs, puzzles, audiovisual material, fictional universe, lore, graphics, trademarks, logos, interfaces, game systems, and other content, excluding User Content owned by users. Subject to these Terms, Parabox grants you a limited, revocable, nonexclusive, nontransferable license to use the Service for personal, noncommercial purposes.
19. Changes to the Service
Parabox may add, modify, rename, discontinue, rebalance, relocate, or remove features, experiences, game mechanics, locations, content, ranks, rewards, or other aspects of the Service. We will comply with applicable law regarding material changes affecting paid services.
20. Beta and TestFlight Features
Pre-release, beta, experimental, or TestFlight versions may contain errors, incomplete functionality, resets, unavailable content, or significant changes. Do not rely on beta functionality for emergencies, navigation safety, or preservation of important information.
21. Assumption of Ordinary Risks
Real-world exploration involves risks including traffic, weather, terrain, animals, other people, physical exertion, property conditions, and environmental hazards. To the extent permitted by law, you acknowledge and accept the ordinary risks inherent in voluntarily participating in real-world activities. This provision does not waive rights or liabilities that cannot legally be waived.
22. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PARABOX DOES NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, ERROR-FREE, ACCURATE, SAFE, OR SUITABLE FOR EVERY LOCATION OR USER. LOCATION INFORMATION, GPS DATA, MAPS, ROUTES, AUGMENTED-REALITY PLACEMENT, AND USER-SUBMITTED INFORMATION MAY BE INACCURATE.
23. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARABOX AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARABOX'S AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO PARABOX DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Parabox and its officers, employees, contractors, and agents from third-party claims arising from your unlawful conduct, violation of these Terms, User Content, or infringement of another person's rights.
25. Suspension and Termination
You may stop using Parabox or delete your account at any time using the account deletion feature provided through the Service. Account deletion will be handled as described in the Privacy Policy. Deleting your Parabox account does not automatically cancel an active App Store subscription; subscriptions must be canceled through the applicable marketplace.
We may suspend or terminate accounts that violate these Terms, threaten safety or security, engage in fraud or abuse, belong to or are independently operated by users we learn are under 18, or expose Parabox or others to material legal or operational risk.
26. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a lawsuit arising out of these Terms or the Service, you and Parabox agree to make a reasonable good-faith effort to resolve the dispute informally. You may contact Parabox at [email protected].
To the extent permitted by applicable law, any legal proceeding arising out of or relating to these Terms or the Service must be brought in a state or federal court located in Texas, and you and Parabox consent to the jurisdiction of those courts.
Nothing in these Terms limits any rights or remedies that cannot lawfully be waived.
27. Changes to These Terms
We may update these Terms as Parabox evolves. When changes are material, we will provide notice as required by applicable law. The effective date above indicates the most recent revision.
28. Additional Terms
Certain features, purchases, events, experiences, promotions, physical products, partner services, or other offerings may be subject to additional terms presented to you before you participate or purchase. Those additional terms become part of your agreement with Parabox when you accept them. If additional terms conflict with these Terms regarding the specific offering they govern, the additional terms control with respect to that offering.
29. General Terms
Entire Agreement. These Terms, together with any additional terms that apply to particular features, purchases, experiences, events, or services, constitute the entire agreement between you and Parabox concerning the Service and supersede prior agreements or understandings concerning the Service.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, if necessary, severed, and the remaining provisions will remain in effect.
No Waiver. If Parabox does not enforce a provision of these Terms, that does not waive our right to enforce it later. A waiver of one provision or violation does not constitute a waiver of any other provision or violation.
Assignment. You may not assign or transfer your rights or obligations under these Terms without Parabox's prior written consent. Parabox may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.
Survival. Provisions that by their nature should continue after termination of your account or these Terms will survive, including provisions concerning intellectual property, User Content licenses to the extent applicable, disclaimers, limitation of liability, indemnification, and dispute resolution.
Headings. Section titles and headings are provided for convenience only and do not affect the interpretation of these Terms.
